This Privacy Policy (this “Privacy Policy”) explains what information is collected and how it is used and protected by PacsDrive, LLC (“PacsDrive”), its websites (including www.pacsdrive.com) and its products and services (collectively, the “Services”). It also explains the choices you have about the way this information is collected and used. Please review this Privacy Policy periodically for current information, as it may be updated from time to time.
By registering for or using the Services, you agree to the terms and conditions of this Privacy Policy.
Definitions.
As used in this Privacy Policy, the following terms have the following meanings:
“Personal Information” means information that identifies or can be used to identify you, including, but not limited to your name, mailing address, email address, date of birth, telephone number, billing information, username, password and other data that can be reasonably linked to such information.
“Patient Data” means any patient data and file information you transmit to PacsDrive pursuant to the Services.
“User Information” means Personal Information and Patient Data.
You are in control of your information.
You may update or remove your Personal Information at any time by signing in to www.pacsdrive.com or contacting PacsDrive support. To remove your Personal Information, please visit your account settings page and click “Cancel My Account.” PacsDrive may retain User Information in its archives or backup records as a safety precaution after cancellation of your account.
How PacsDrive Collects Personal Information.
PacsDrive does not collect Personal Information from you unless you voluntarily provide it to us, including when you:
* register with PacsDrive or use the Services
* register to receive information from PacsDrive and its affiliates
* send questions, comments, or other messages to PacsDrive; or
* request specific information, materials, or service.
PacsDrive does not knowingly collect Personal Information from individuals under the age of 13. If we determine that we have collected Personal Information from an individual under the age of 13, we will delete it from our databases and will not use or share the information.
How PacsDrive Uses Personal Information.
PacsDrive is committed to providing a high-performance, secure, easy-to-use medical image archiving service. Personal Information is used exclusively with the goal of providing and improving this service, including to:
- register you for the Services;
- create and maintain your account;
- provide you with information related to your account and the Services;
- respond to your messages, questions and requests;
- improve the Services; or
- otherwise fulfill the purpose for which you provided the information.
Disclosure of Personal Information.
PacsDrive will not sell, rent, trade or give away any Personal Information (identified or de-identified) you provide to PacsDrive to any third party, except under the following limited circumstances:
- It is shared in aggregate, non-personal form (e.g., visitor demographic statistics).
- It is shares with a third party that assists PacsDrive in the processing of credit card orders.
- You specifically authorize PacsDrive to share it with the third party.
- It is necessary or advisable to verify information that you provide to PacsDrive.
- It is in connection with an audit of PacsDrive.
- PacsDrive believes it is required to do so by applicable law or regulation.
- To protect and defend the rights of PacsDrive.
- It is in connection with a change of control, merger or acquisition of PacsDrive, or selling some or all of PacsDrive’s assets. See “Change of Ownership” below.
Collection of Non-Personal Information.
When you visit www.pacsdrive.com and other PacsDrive websites PacsDrive servers automatically collect and store certain non-Personal Information about you. This information may include, the domain name from which you access the Internet, your IP address, browser type, page requested, cookie information, the date and time you accessed the site, the length of site visits, the Internet address of any website from which you linked directly to this site, and the particular items or pages that you viewed or downloaded during your visit. This information is used to provide a custom experience, keep your session active, or improve the service. From time to time, PacsDrive may also ask you to provide other anonymous demographic information, such as your age and gender.
PacsDrive uses non-Personal Information in any way that it determines is useful to it, including to maintain and improve the quality of its products and services and to offer information and promotions.
Cookies and Other Technologies.
If your browser accepts "cookies," PacsDrive may use cookies to determine if you are a repeat or new visitor; to understand how many different visitors come to this site; to personalize your information on future visits; to offer you information that is appropriate to your demographics, interests and preferences; and to monitor and improve its services to you.
In addition to cookies, PacsDrive may use pixels, or transparent GIF files, on our sites provided by one or more third-party service providers, based on our specification as to where they are used. These files enable PacsDrive service providers to recognize a unique cookie in your Web browser, which, in turn, enables PacsDrive to learn how you arrived at our site and how you use the site. These technologies are used solely for our internal purposes in managing the site, improving its functionality and enhancing customer support and site usability.
The PacsDrive software is designed to permanently archive medical images and contains no spyware or other unwanted applications. The uninstaller provided to you will completely remove PacsDrive software from your system.
Backup Service; Patient Data.
By using our backup service, the PacsDrive system automatically encrypts and transfers your files to PacsDrive servers. Certain information will be available to PacsDrive such as type of operating system, file types, or sizes to enable PacsDrive to provide the service or help support you. PacsDrive will never look at your actual images and any access to Patient Data requires your explicit consent. PacsDrive will never share any Patient Data with third parties without your prior express written permission, except to the extent PacsDrive believes it is required to do so by applicable law or regulation. We may view your file system information (file extensions, sizes etc.) with your express consent, but not your file contents, to provide technical support.
Service Providers.
PacsDrive does not disclose Personal Information to service providers, except to process credit card transactions. The data used to process credit card transactions adheres to a strict privacy policy supported by TrustWave and the Payment Card Industry Data Security Standard (PCI DSS). PacsDrive may use third party service providers (e.g. hosting providers) and your data will only be stored in encrypted form and only as necessary to provide you the service. PacsDrive may share certain aggregated non-personal information (such as total volume of data PacsDrive stores) with third parties.
Change of Ownership.
In the event PacsDrive is involved in a merger, acquisition, or any form of sale of some or all of its assets, PacsDrive reserves the right to transfer all of PacsDrive User information, including Personal Information, to a separate entity. We will use commercially reasonable efforts to notify you (by posting on our website or an email to the email address for you in our records) of any change in ownership, merger or acquisition of PacsDrive’s assets by a third party, and you may choose to modify any of your registration information at that time.
Links.
The PacsDrive web site may contain links to sites that are not under our control. Please read each site's privacy policy carefully, since it may differ significantly from this Privacy Policy. PacsDrive is not responsible for the privacy policies, content or practices of other sites we provide these links solely for the convenience and information of our visitors.
Security.
PacsDrive is committed to the security of your data and has put in place industry standard physical and electronic enforcement mechanisms. PacsDrive products automatically encrypt your data before transmission and send the encrypted data using industry-standard Secure Socket Layer (SSL) encryption. Your data is stored encrypted in a physically secure location with controls for restricted access, reasonably protected from unauthorized access, misuse, alteration or disclosure. Only authorized PacsDrive employees can gain access to User Information. Additionally, any access to Patient Data requires your explicit consent. Although we make good faith efforts to store User Information you provide to PacsDrive in a secure operating environment that is not available to the public, PacsDrive cannot guarantee complete security. Further, while we take reasonable steps to ensure the integrity and security of our network and systems, we cannot guarantee that our security measures will prevent third-parties from wrongfully obtaining User Information.
Storage and processing may take place in the United States or any other country where PacsDrive or its affiliates maintain facilities. By using the PacsDrive web site, the Services or otherwise providing information to us, you consent to any such transfer of information outside of your country. If you are located outside of the United States, you should be aware that your User Information will be transferred to our servers, and the USA currently does not have uniform data protection laws.
Communication.
PacsDrive may contact you via email as reasonably necessary to inform you of service-related information such as confirmation of a password change, expiration of a credit card, notification of a service issue, or availability of a new product or feature from PacsDrive. PacsDrive does not intend to advertise for other organizations through its website or email communications and will not contact you to promote third party products. PacsDrive also may contact you via phone for support purposes if you provide PacsDrive your phone number.
Privacy Policy Changes.
PacsDrive may revise, amend or modify this Privacy Policy from time to time in its sole discretion. Any change to this Privacy Policy will be posted on the PacsDrive web site at www.pacsdrive.com/privacy and, in the case of a material change, PacsDrive will announce such change more prominently (which may be by email notification). Your continued usage of the Services expressly constitutes consent to any changes.
No Liability.
As explained in the Terms of Service, TO THE FULLEST EXTENT PERMITTED UNDER APPLICABLE LAW, IN NO
EVENT WILL PACSDRIVE BE LIABLE TO YOU FOR ANY INDIRECT, CONSEQUENTIAL, INCIDENTAL, EXEMPLARY OR SPECIAL DAMAGES
RESULTING FROM YOUR USE OF THIS SITE OR PROVISION OF INFORMATION TO COLUMBIA, INCLUDING ANY FAILURE BY PACSDRIVE OR
AN AFFILIATE TO COMPLY WITH THIS PRIVACY POLICY, EVEN IF PACSDRIVE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH
DAMAGES.
